State prosecutors have a week to respond in court before Ryan Ferguson could walk out of prison as a free man. Ferguson was cleared of murder charges Tuesday and his lawyer, Kathleen Zellner says they filed a bond motion to try and get him out of jail in less than the 15 days the state has to re-file charges.
“So the ball is in their court now. They can abandon all of this, or they can continue on,” says Zellner.
She says she is confident that the Missouri Supreme Court would not overturn this decision, but she says friends and family aren’t assuming anything yet.
She says the opinion filed by the Court of Appeals details every aspect of the case and she thinks it will become precedent in future cases.
